These terms and conditions govern access to and usage of this site www.fnbconnect.co.za (“Site”), as well as access to and usage of all Products and Promotions as defined herein, or as provided on this Site. We affirm that we cannot be bound by any representation, warranty, promise or the like not recorded in these terms and conditions (“Ts & Cs”).
These Ts & Cs as amended from time to time govern our respective rights and obligations. Headings are for convenience only and will not be used in the interpretation of these Ts & Cs.
Access and usage of this Site includes, but is not limited to, the purchase of any and all Products via this Site. You acknowledge that you are not obliged to access this Site or purchase any of the Products, as defined herein.
FNB Connect reserves the right, at our sole, absolute and final discretion to amend (including, without limitation, by the addition of new terms and conditions) these Ts & Cs at any time and without prior notice to you. Kindly check these Ts & Cs periodically for any changes.
Your access and usage of this Site or purchase of the Products indicates your acceptance of these Ts & Cs, which are valid, binding and enforceable against all persons that access this Site.

Daily Limit
Your use of the Products in respect of top-up’s is limited to R1 000.00 (one thousand Rand) per day. Should you wish to exceed this limit, kindly mail support@fnbconnect.co.za and your request may be considered.

Once-off Free Allocation | Back to Top
As of February 2010, upon successful registration at www.fnbconnect.co.za a new customer will be provided with a once off allocation of 1 (one) Gigabyte only of free Connect Surf data. At present, this is restricted to ADSL data only, but please keep visiting our Site for future enhancements and innovations. You will also be provided with R10 (ten Rand) free Connect Talk voice airtime. This may be retracted or restricted at any time by FNB Connect without notice to you.
This offer specifically excludes any multiple logon’s and is provided you have not already received any such allocation before. These allocations are not transferrable or redeemable for exchange or cash.
You hereby warrant that your registration is with the intention of using the Product and not solely for the allocation of the 1 Gigabyte of data and R10 (ten Rand) of voice. You further warrant that you are a first time user and that you have not formerly registered.

Automatic Top Up
Your attention is drawn to the Automatic Top (Auto Top Up) function which appears on the Top Up confirmation screen.  When topping up ADSL Bundles, Talk or Surf Accounts for the first time, the “Enable Auto Top Up” icon will be pre-selected.  This means that your account will be topped up every month for the same amount as initially selected.  Should you decide not to avail of the Auto Top Up system; it is incumbent upon you to simply click the Auto Top box to deselect the option.  This will effectively prevent the Auto Top function from being activated.
You may at any time change the default Auto Top amount that was selected upon initial Top Up by selecting the Auto Top up menu on the CPMS.

Connect Surf
General
It is your responsibility to ensure that you are enabled to access and use Connect Surf, whether with regard to hardware (including PC minimum requirements), internet connectivity or otherwise. Aside from the once off free allocation as set out above, data can be purchased by you via our Site by way of either ad hoc purchases OR automatic top up of your Connect Surf account. The value amount of such ADSL data as topped up to your Connect Surf account may not be transferred to any Connect Talk account which you may hold.
By so topping up your Connect Surf account, you grant FNB Connect permission to deduct the amount as inputted by you from the FNB transactional banking account as selected by you OR the bank account created for you as per point 2 under “Eligibility” above. FNB Connect will provide you with an opportunity to review the transaction, correct any errors and to withdraw from the transaction, but once the transaction has been confirmed, you acknowledge that such transaction cannot be reversed or terminated. You further acknowledge that all transactions are final and no refunds will be made. Any billing disputes will be assessed on a case by case basis.
Any and all rates charged to you, in respect of your access to or usage of Connect Surf will be as published on this Site from time to time. Any and all rates charged to you, in respect of your access to or usage of Connect Surf, may be amended by us at any time, at our sole, absolute and final discretion, and without prior notice to you. Such amended or altered rates will be effective and applicable, in respect of your access to and/or usage of Connect Surf, as from the date such amended rates are published on this Site.


ADSL Bundles
Scope
We provide you with a broadband internet access service (hereafter referred to as “ADSL Bundles) that permits access to the Internet and other related services by means of ADSL technology.
Prequalifying criteria
In order to purchase ADSL Bundles you are required to have a valid and active Connect Surf account. 
Purchase of Bundles
The ADSL Bundles are strictly prepaid and must be purchased before they can be used to access data.
In order to purchase the ADSL Bundles you are required to access the Site and then select the customer portal management system (CPMS).  The ADSL Bundles tab will be among the displayed options. Select this tab and follow the prompts.
Only one ADSL Bundle may be purchased per transaction.
ADSL Bundles may be purchased at any time during the month.
Expiration of ADSL Bundles
The ADSL Bundles expire:

For clarity it is recorded that data which is not used within the allocated 30(thirty) day period is not carried forward.
General
The Bank will have the right to withdraw or change the ADSL bundle offering immediately and without notice to you.  In the event of such termination, you agree to waive any rights that you may have in terms of this service and acknowledge that you have no recourse against the Bank, its agent’s affiliates or partners.

Prepaid Vodacom 3G
Scope
We provide you with a service that allows you to access the internet and email from your laptop, mobile phone or suitable device using the 3G network.
Eligibility
In order to use the 3G service, you need to have valid a Connect Surf account.
This is strictly a pre-paid service. It is your responsibility to ensure that you have the requisite amount of funds available in your account.
Only customers who have a contract with a Vodacom Service Provider may access this service. Top-up or hybrid contracts are specifically excluded. For clarity “hybrid contracts” refers to contracts which may be topped up during the month using prepaid vouchers. This may change from time to time and you are encouraged to visit the Site for changes.
The 3G network may be accessed from your mobile device provided that it has the capability to access the internet and email.
It is your responsibility to ensure that you have the requisite hardware and technology to access this service.
Purchase
In order to access the service you must have sufficient funds in your Connect Surf prepaid account.
Each time you log on to the 3G network using your Connect Surf account you consent that we may deduct the apposite amount from your account
You may top-up or purchase access in any denomination from a minimum of R5 (five) rand up to a maximum of a R1000 (one thousand rand) daily.
Once the balance in your account is depleted your access to the 3G network will be suspended until such time that your account is topped up.
Provisioning
In order to access the service your SIM card must first be provisioned or enabled to receive the service.
In order to do this, you must log on to the CPMS and click onto the 3G tab provided and follow the prompts.
Once the process is completed and a request submitted you will be notified by SMS as soon as the provisioning has been successfully completed. Kindly be advised that the provisioning process can take approximately 7 (seven) days. Due to the reliance on third parties for the provisioning process we are unable to guarantee this time frame for the provisioning process.
Exclusions
The initial free Gigabyte, cheque rewards free data and ADSL Data Bundles cannot be used for access to the 3G network.
International roaming is specifically excluded from this service offering.
The Educational Site Promotion and the free social networking promotions are specifically excluded and do not form part of the 3G service.
Inclusions
ADSL and 3G may be used simultaneously but are billed individually at the respective rates.
Service Limitations
Whilst we make every reasonable effort to ensure that the service is available 7 (seven) days a week 24 (twenty four) hours a day, we are unable to guarantee availability of the service. We shall not have any liability to you for any unavailability of the service, and are under no obligation to provide you with maintenance, technical support or updates but will endeavour to do so. We reserve the right to suspend access to your account if your use of the Service disrupts, impedes or otherwise negatively impacts the operation of our service or use of our service by other customers.
The Bank will have the right to terminate this service immediately and without notice. In the event of such termination, all participants agree to waive any rights that they may have in terms of this service and acknowledge that they will have no recourse against the Bank, its agents and/or promoters.

3G Vodacom Bundles
Scope
We provide a service that permits our customers to purchase 3G Vodacom Bundles via the Customer Portal Management System (CPMS).
The purchase and use of this service is subject to these Ts & Cs as well as the terms and conditions of the service provider. Kindly refer to the Vodacom website for a comprehensive list of Vodacom’s terms and conditions.
Exclusions
This service may not be utilised by Vodacom contract customers. For clarity only customers on the Vodacom prepaid option or on Hybrid contracts (Top up contracts) may use this service.
Prequalifying criteria
In order to use this service you must be registered with us.
In addition you must have a Vodacom Hybrid contract or be a Vodacom prepaid customer.
Purchase of 3G Bundles
The 3G Bundles are strictly prepaid and must be purchased before you can access the Internet.
The system will provide you with an opportunity to verify your cellular phone number, bank account details and purchase denomination. You are advised to ensure the accuracy of the information entered as once the information is confirmed it cannot be reversed.
The prices of the 3G Bundles may change from time to time without prior notice to you. You are advised to refer to the Site periodically to familiarise yourself with the most up to date pricing options.
Termination and Expiration
Vodacom bundles have an expiration date which is determined by Vodacom. Kindly familiarise yourself with the relevant expiration dates for this service offering as defined by Vodacom by acquainting yourself with Vodacom’s Ts &Cs.

Prepaid MTN 3G
Scope
We provide you with a service that allows you to access the internet and email from your laptop, mobile phone or suitable device using the 3G network.

Eligibility
In order to use the 3G service, you need to have a valid Connect Surf account.
This is strictly a pre-paid service. It is your responsibility to ensure that you have the requisite amount of funds available in your account. 
Only MTN contract customers may access this service.  Top-up or hybrid contracts are specifically excluded. For clarity “hybrid contracts” refers to contracts which may be topped up during the month using prepaid vouchers. This may change from time to time and you are encouraged to visit the Site for changes.
The 3G network may be accessed from your mobile device provided that it has the capability to access the internet and email.
It is your responsibility to ensure that you have the requisite hardware and technology to access this service.

In order to access the service you must have sufficient funds in your Connect Surf prepaid account.

Wi-Fi Vouchers
General
FNB Connect will be selling Wi-Fi Vouchers (vouchers) to its customers to permit access to the services of participating Wi-Fi Hotspots.  By purchasing or using our voucher you agree to be bound by these Ts & Cs.
We reserve the right to suspend or withdraw this offer at any time without notice to you.
These Ts & Cs are subject to change and you are encouraged to check the Site regularly for changes and updates.
Purchase of Vouchers
Currently you can only purchase vouchers via the Site but you are encouraged to check the Site periodically as this may change to include alternative sales channels.
Vouchers are non refundable and may not be redeemed for cash.
Use
The voucher may be used at any participating Wi-Fi Hotspot to access electronic communication services (services) and facilities.
We, our affiliates, strategic partners and third party service providers and their respective directors, officers, employees and agents are indemnified against harm from any claim or demand, made by any third party due to or arising out of content you communicate using the service.
You may not use any Wi-Fi Hotspot, any Internet access or your Wi-Fi voucher in any manner that violates any rule, law regulation or applicable policy.
Indemnity
Access to the Wi-Fi Hotspots is undertaken solely at your own risk and we cannot be held responsible for any loss or harm suffered to person or possession as result of such access.
We cannot be held liable for any inability to access the Internet or make use of the services where such inability is caused by amongst others force majeure or third party failures. Further we cannot be responsible for lost data, or data which is undelivered, delayed or misdirected because of interruptions or performance issues with the communication services or communications networks.
The voucher may be used at any participating Wi-Fi hotspot.  Notwithstanding the aforegoing we do not guarantee the availability of service at all times at participating Hotspots.
We are unable to guarantee that the service will be error free, uninterrupted or virus free. You are encouraged to ensure that your device is equipped with relevant anti-malware protection.
Hardware Compatibility
It is the responsibility of the customer to ensure that they possess the requisite wireless local area network compatible device in order to access the Services.
We make no representations as to speeds and performance of the service which may be subject to the limitations of your device, your location in a Hotspot and the effective functioning of a third party network.
Termination and expiration
Vouchers will expire with the attainment of the maximum usage time or the attainment of the maximum allocated Megabytes.  For time based vouchers utilisation of access is measured in units where each unit equals one minute.  Any portion of one minute will be rounded to the next completed minute.  For data based vouchers utilisation of access is measured in units where each unit equals one megabyte. 
Where the maximum usage is not reached the voucher will expire 30 (thirty) days after the date of purchase.
Complimentary vouchers
Complimentary vouchers are subject to these Ts & Cs.
A complimentary voucher will expire thirty days after being issued.

DStv on Demand
Scope
We offer FNB Connect Surf customers who have an ADSL line and subscribe to DStv’s Premium Bouquet access to the service known as DStv on Demand.
DStv on Demand can be viewed from your personal computer (this includes laptops) provided it has the necessary technical capability to support the service. Refer to the DStv on Demand website for more details on the technical specifications necessary to support this service.
The service does not require payment but you are charged data costs when Streaming or Downloading the content to personal computer.
Exclusions
You may not access the service using the 3G or Wi-Fi networks.
You may not access the service if your subscription is for any bouquet except the Premium Bouquet. This may change in the future and you are encouraged to visit the website periodically for updates.
Prequalifying criteria
In order to access DStv on Demand you are required to have a valid and active Connect Surf account with an ADSL line and you must be a DStv Premium Bouquet subscriber.
Access and Use of the Service
This service is available to subscribers within the Republic of South Africa.
DStv on Demand may either be Downloaded or may be viewed via Streaming. You are advised that content which is Downloaded expires after seven (7) days. You are not allowed to permanently Download programmes.
Whilst we make every reasonable effort to ensure service is available twenty four (24) hours, seven (7) days a week we are unable to guarantee services.
We have no control over the programmes which are available and accordingly we cannot be held responsible for any inconvenience which may be suffered as result of programmes being withdrawn.
You are advised that restriction of inappropriate programming must be managed by yourself and we accept no liability in this regard.
The quality of viewing is dependent on available bandwidth as well as the device used. Using the inappropriate technology can reduce viewing quality. You are advised to ensure that the device used accords with the technical requirements in order to ensure optimal viewing.
The service may be accessed using both purchased data as well as data which are allocated to you in accordance with our various promotions.
It is your responsibility to ensure that you have sufficient data before you access this service. We cannot be held liable for any inconvenience suffered as a result.
You may abort a Download at any point and you will be charged only for the data used up to the point of termination.
No data will be refunded under any circumstances.
General
The Bank will have the right to withdraw or change the conditions of service without notice. In the event of such termination, you agree to waive any rights that you may have in terms of this service and acknowledge that you have no recourse against the Bank, its agent’s affiliates or partners.
This service must be accessed and used in accordance with these Ts & Cs, our Acceptable Usage Policy as well as the terms and conditions set by Multichoice. Kindly visit the DStv on demand website for full terms and conditions.
Should you fail to adhere to the AUP or the Ts & Cs we may terminate your access to the service.

Business Surf
Scope
We offer an internet service solution to small, medium and micro enterprises which enables one to access the Internet and have access to e-mail.
Currently this is applicable to Sole Proprietors only but this may change and you are encouraged to visit the Site periodically.

The rates for Business Surf differ from the rate for Connect Surf. This may change periodically and you are encouraged to check the Site periodically for updates.
This service may not be resold on sold at any time.
It is permissible to have both a Business Surf and a Connect Surf account.
This is strictly a prepaid service at present.
General
The Bank will have the right to withdraw or terminate the Business Surf offering immediately and without notice. In the event of such termination, you agree to waive any rights that you may have in terms of this service and acknowledge that you have no recourse against the Bank, its agent’s affiliates or partners.
The use of this product is subject to these Ts & Cs as well as our acceptable use policy. This may change from time to time without notice to you so ensure that you visit the Site periodically to apprise yourself of any changes.

Connect Talk
General
It is your responsibility to ensure that you are enabled to access and use Connect Talk, whether with regard to hardware (including mobile phone compatibility), internet connectivity or otherwise. For your convenience, a list of compatible mobile phones is published on the Site. Whilst every effort is made to ensure accuracy, we make no guarantees about the accuracy, reliability or completeness of this information. The list does not in any manner guarantee compatibility and we cannot be held liable for any reliance placed thereon.
By topping up your Connect Talk account, you grant us permission to deduct the amount as inputted by you:
a) from the FNB transactional banking account selected by you OR
b) the bank account created for you as per point 2 under “Eligibility” above.
FNB Connect will provide you with an opportunity to review the transaction, correct any errors or to withdraw from the transaction, but once the transaction has been confirmed, you acknowledge that such transaction cannot be reversed or terminated. You further acknowledge that all transactions are final and no refunds will be made.
Any and all rates as may be charged to you, in respect of your access to or usage of Connect Talk, will be as published on this Site from time to time. Any and all rates, as may be charged to you,  in respect of your access to or usage of Connect Talk, may be amended by us at any time, at our sole, absolute and final discretion and without prior notice to you. Such amendments will be effective and applicable, in respect of your access to or usage of Connect Talk, as from the date such amended rates are published on this Site.
You will not be charged by FNB Connect for on-net calls. However, you may be charged for on-net calls by other service providers or parties with regard to, amongst other things, internet connectivity.
If you register for FNB Connect and are unable to make outbound calls or send short messages (sms) but wish to do so you will have to upgrade your account to enable these services. Account holders who do not have the capability to make outbound calls and send sms will still be able to invite friends on the social networking sites and make free on net calls to other registered FNB Connect users as well as send free instant messages to other registered users. For more details kindly refer to the frequently asked questions (FAQ’s) on the Site.
Free Connect Talk number
Upon your registration for Connect Talk, you will receive 1(one) free VoIP number, provided that you have not previously registered for any VoIP product from FNB Connect. If you wish to request additional numbers you will be charged a service fee of R50 (fifty Rand). It is very important to note that you are not paying for the VoIP (087) number, you are paying a once off service fee, to enable you to make more on-net calls, subject to the fair usage policy as set out in these Ts & Cs.  Upon your deregistration for Connect Talk, you will no longer be able to access nor be able to use any of the VoIP numbers, fax numbers or email addresses received by you as a result of your registration for Connect Talk, nor any of the such items purchased by you while so registered.
Aside from the once off free allocation as set out above, Connect Talk, will be purchased by you via our Site by way of either ad hoc purchases OR automatic top up by way of top up of your Connect Talk account. The value amount of such call minutes as topped up to your Connect Talk account may be transferred to any Connect Surf account which you may hold.

Business Talk
Scope
We offer a voice solution to small, medium and micro enterprises which enables one to make and receive on net calls.
Currently this is applicable to Sole Proprietors only but this may change and you are encouraged to visit the Site periodically.

Prepaid Vouchers | Back to Top
We have sole discretion over the enforcement of the Ts & Cs surrounding the voucher whether received or purchased in any capacity and you accept that our decision is final and no further judgement will be entertained.
The rates in respect of Connect Surf and Connect Talk on the voucher may be different to the rates acquired through your customer top up account. You are encouraged to compare the rates prior to purchasing a voucher.
Vouchers are not redeemable, exchangeable, or refundable for cash.
FNB Connect cannot not be held liable for passwords which are compromised or the loss of voucher by whatever means.  Any loss of value on the voucher for whatever reason will be solely for your account.
By purchasing any voucher or loading value onto such voucher, you grant FNB Connect permission to deduct the amount as inputted by you from:

You will be given an opportunity to review and correct the transaction, or to withdraw from the transaction but, once confirmed, transactions cannot be reversed.
Once the value as reflected on the voucher is depleted, you will be able to load further value onto the prepaid voucher by means of top up, provided that such option to top up is exercised within 10 (ten) days of the date that the original value, as reflected on the voucher, is depleted. Failing such action, the voucher will expire.
Any value reflected on or contained on the voucher cannot at any point be transferred into an FNB account.
A maximum of 10 (ten) vouchers may be purchased within any single session.
If you breach these Ts & Cs in any manner whatsoever or FNB Connect determines at our sole, absolute and final discretion to be inappropriate, undesirable or illegal FNB Connect reserves the right to terminate your access or usage in respect of any voucher and to prohibit your future access or usage in respect of any voucher, at any time and without prior notice.
You agree that FNB and its affiliates, shareholders, agents, consultants or employees cannot be held liable for any loss or damage whatsoever which may be suffered by you as a result of purchase of, access to or usage of any voucher, the theft or loss of any voucher or the compromising of any username or password associated with any voucher, as a result of your inability to purchase, access or use any voucher.

We have sole discretion over the enforcement of the Ts & Cs surrounding the voucher whether received or purchased in any capacity and you accept that our decision is final and no further correspondence will be entertained.
The rates in respect of Connect Surf, Connect Wi-Fi and Connect Talk on the voucher purchased via the ATM may be different to the rates acquired through your customer top up account. You are encouraged to compare the rates prior to purchasing a voucher.
Vouchers are not redeemable, exchangeable, or refundable for cash.
We cannot not be held liable for passwords which are compromised or the loss of a voucher by any means.  Any loss of value on the voucher for whatever reason will be solely for your account.
By purchasing any voucher or loading value onto such voucher, you grant FNB Connect permission to deduct the amount as inputted by you from:

You will be given an opportunity to review and correct the transaction, or to withdraw from the transaction but, once confirmed, transactions cannot be reversed. You are therefore encouraged to ensure that all information inputted is correct including the cell phone number as the transaction cannot be reversed once confirmed.
All vouchers purchased via the ATM expire 30(thirty) days after purchase. The expiration date of the voucher will be sent to the appointed cell phone number together with the voucher.
Any value reflected on or contained on the voucher cannot at any point be transferred into an FNB account.

Connect Fax
Upon your registration for Connect Talk, you will receive 1(one) free fax number provided that you have not previously registered for any VoIP product from FNB Connect.
Additional fax numbers may be purchased from us as items at the rates published on this Site from time to time.
Connect email
Upon your registration for Connect Surf or Connect Talk, you will receive 1(one) free email address number, provided that you have not previously registered for Connect Surf from FNB Connect.
Additional email addresses may be purchased from us as items at the rates as published on this Site from time to time.
Upon your deregistration for Connect Surf, you will no longer be able to access nor be able to use the email addresses whether purchased or received free as a result of your registration for Connect Surf.
Connect Voice Recordings
History of voice recordings may be kept on your behalf for up to 100 (one hundred) minutes only, thereafter FNB Connect will email you your old recordings and thereafter delete those recordings from the FNB Connect server to make room for new recordings when the threshold of up to 100 (one hundred) minutes has been reached. The email will be sent to your address listed upon registration and FNB Connect assumes no liability whatsoever for the mail not being received by you.
Whilst we make every endeavour to deliver this service we cannot guarantee the retrieval or quality of the voice recordings.

Password and User name
You will be solely and fully responsible for any and all activities which may occur under your password, username or account designation. You hereby indemnify us in respect of any loss or damage whatsoever which may arise out of any activity as may occur under your password, username or account designation.

Termination of Access or Usage
If you breach these Ts & Cs in any manner whatsoever or FNB Connect determines at our sole, absolute and final discretion to be inappropriate, undesirable or illegal we reserves the right to terminate your access or usage in respect of any voucher and to prohibit your future access or usage in respect of any voucher, at any time and without prior notice.
We will not be liable for any loss or damage whatsoever which may be suffered by you or any third party as a result of the termination of your access or usage in respect of this Site or the prohibition of your future access or usage in respect of this Site (including but not limited to your ability to purchase any or all Products via this Site), in any manner whatsoever.
In the event of such termination or prohibition, you agree to waive any rights you may have in terms of these Ts & Cs and acknowledge that you will have no right of recourse whatsoever against us.

Should we become aware that your usage of our products/promotions is excessive, unlawful or not in accordance with our fair usage policy, we reserve the right to recover any amounts which may be applicable from you.
You may not misrepresent your assigned 087 number to third party service providers as belonging to FNB Connect. Should you use the number to encumber a debt we reserve the right to take whatever action against you we deem necessary including recovering the outstanding amount from you.

Availability
The Site may be unavailable from time to time, due to, amongst others, routine maintenance, emergency repairs or because of the unavailability of any electricity or telecommunication system or networks. We will not be liable to you for any unavailability under any circumstances whatsoever.

To the fullest extent permissible by law, no warranties, whether express or implied, are made of any kind in respect of the Site or any of the Products or Promotions, including but not limited to the availability of the Site or the availability of any of the Products or the suitability of the Products for any purpose whatsoever.
Limitation of Liability

You agree that FNB and our affiliates, shareholders, agents, consultants or employees will not be liable for any damages or loss of any kind whatsoever or howsoever caused as may arise as a result of your access to or usage of this Site. We do not monitor any content which is accessed except in accordance with a court order.
Notwithstanding the above we strictly prohibit the accessing of illegal material which includes but is not limited to child pornography, copyrighted material, material which is malicious or racist, violent or harmful. Should we become aware that you have violated these Ts & Cs we reserve the right in our sole discretion to take any action that we deem necessary including suspension or termination of your account.
We strictly prohibit the misrepresentation of your assigned 087 number as belonging to FNB Connect. Should you in any way encumber your number with a third party service provider we reserve the right to take any action we deem necessary which includes but is not limited to termination or suspension of your account or the recovery of the debt directly from you.
The services and products provided by us are strictly for your own use and may not be on-sold or resold.
Take down notice
We confirm our commitment to taking down material which is unlawful.
In accordance with section 77 of the Electronic Communications and Transactions Act 25 of 2002 (ECT) we have designated the Internet Service Providers Association (ISPA) as our agent in this regard. Spam

Webmail and other web based email services made available by us are provided on an "as is" basis without representations, warranties or conditions of any kind, and the customer acknowledges and agrees that we shall have no responsibility for, or liability in respect of, any aspect of the Webmail services, including without limitation for any lost or damaged data or any acts or omissions by us. As webmail storage space is limited, some Webmail messages may not be processed due to space constraints or message limitations.

Webmail is provided to individuals and for personal use only. Any unauthorised commercial use of the Webmail service or resale of the Webmail service is expressly prohibited.

Protection of Minors
We prohibit customers from using our service to harm or attempt to harm a minor, including, but not limited to, by hosting, possessing, disseminating, distributing or transmitting material that is unlawful, including but not limited to child pornography.

User Responsibilities
You are responsible for any misuse of our services that occur through your account. It is the customer's responsibility to ensure that unauthorised persons do not gain access to or misuse our service.

We urge customers not to reply to unsolicited mail or "spam", not to click on any suggested links provided in the unsolicited mail. Doing so remains the sole responsibility of the customer and we cannot be held liable for the Customer being placed on any bulk mailing lists as a result.

Where you have authorised a minor to use any of our services or access its websites, you accept that as the parent/legal guardian of that minor, you are fully responsible for: the online conduct of such minor; controlling the minor's access to and use of any services or websites; and the consequences of any misuse by the minor, including but not limited to transactions entered into by the minor using such access.

We cannot be held liable for any business dealings you have with any third parties on the Internet, including any vendors, or advertisers found on, or through our network. Further, we assume no responsibility whatsoever for any charges you or any user of your account incurs when making purchases or other transactions in this manner. The Law Governing our Relationship
You agree that these Ts & Cs will be governed by and construed and interpreted in accordance with the laws of the Republic of South Africa.
Modification
FNB Connect has the right to change or modify these Ts & Cs at any time without prior notification. Such changes may include, but are not limited to the tariffs charged at any time with the method of notice determined by FNB Connect from time to time.
No Indulgence
The indulgence, extension of time, waiver or relaxation of any of the provisions or terms of these Ts& Cs, or failure or delay on our part to exercise any of FNB Connect’s rights will not operate as an estoppel against us nor will it constitute a waiver by use of such right. FNB Connect will not thereby be prejudiced or stopped from exercising any of our rights against you which may have arisen in the past or which might arise in the future.
Invalidity
Any provision in these Ts & Cs which is or may become illegal, invalid or unenforceable will be ineffective to the extent of such prohibition or unenforceability and will be treated as if it were not written and severed from these Ts & Cs, without invalidating the remaining provisions of these Ts & Cs.
Forex
While FNB Connect uses its best endeavours to quote the most recent foreign exchange rate on the Connect Phone application and/or the website, these rates are subject to rapid fluctuations and we cannot guarantee the accuracy, completeness or correctness of the data.  We cannot be held liable under any circumstances for any reliance placed on them whatsoever. You accordingly indemnify FNB Connect against all claims for loss and damage.  By using the service you indicate your understanding and acceptance of this disclaimer.

Access to the Van Schaik website www.vanschaik.com will be available during the hours of 19h00 - 23h00 to all Connect Surf clients without any data charge.  The free access is restricted to the Van Schaik website only and does not extend to links which connect to external websites.
This promotion commences on the 21 November 2010.  FNB Connect reserves the right to terminate this promotion immediately, at any time and without notice to you or any other party.

Free Social Networking Sites (Facebook and Twitter) promotion
